§ 10.08.085. Evasion of traffic control devices prohibited.

  • A.

    It is unlawful for the driver of any motor vehicle to leave the roadway and travel across private property, or public property devoted to other than highway use, to avoid compliance with an official traffic signal or device or for the purpose of avoiding obedience to directions given by a police officer or any traffic regulation or ordinance.

    B.

    For purpose of this section, a showing that the driver of a motor vehicle: (i) left the roadway and traveled across private property without stopping; (ii) sought to enter a roadway within sixty (60) seconds after leaving one; or (iii) departed a roadway and exceeded the speed limit posted for said roadway before seeking to reenter a roadway, shall be probative toward the existence of intent.

    C.

    A person convicted of evading a traffic control signal, device, directions, or ordinance under this section shall be punished in accordance with Section 10.08.130.
